Frequently Asked Questions About Class Action

What is the minimum of people that must be involved in order for a case to be considered as class action?

There is no minimum requirement and generally the rule counts that it must be almost impossible for all individuals to actively participate in the lawsuit.

How long does it take to receive compensation in a class action suit?

Generally, class action lawsuits take a long time. However, it depends on a number of factors, such as how complex the litigation appears, the number of people involved and therefore the length can range between months and even years.

What can be accomplished with a class action suit?

Just like any other lawsuit, the goal is to fully compensate all injured individuals and to give back what they wrongfully lost or suffered. In the event that consumers can prove that they indeed paid too much for a service or products, the lawsuit would seed to compensate the consumers and return the amount that they were overcharged.

Is it worth taking part in a class action suit? What about risks and expenses?

If you can attest to complaints of a certain class action after personal experiences or damages that you suffered, it is fairly easy to part take in the lawsuit. Once the class action lawsuit has been certified by a court, you may receive compensation that was not available to you in any other forum. On that same note, any costs to proceed with the lawsuit are paid in advance by attorneys, while they work on a contingency fee basis and get paid only upon successful resolution of the matter.

In a securities class action lawsuit, do I need to prove ownership of my stocks?

Yes. The confirmation slips that you receive after a stock is purchased is probably the best piece of documentation. If that is not available to you, you may also use your brokerage statements indicating when you bought the stock and how much it was. While you will receive notification when it is time to send the documents in, you should always make sure to keep them in a safe place.

What do I have to do when several law firms filed a suit for the same issue?

You do not have to contact all of them. If the court receives several complaints about the same violation, the case will be consolidated. At the same time, you should not be represented by multiple law firms, as this does not improve your chances or the amount of compensation.

What are the requirements for a representative plaintiff?

The representative plaintiff must show that:

  • He/she would represent the interests of the class adequately and fairly
  • He/she has a plan for the action that would settle the claims of the class and that the class members have been notified of the action plan.
  • He/she does not have an interest that is in conflict with the other class members on the common issues.
